The implementation of EU-compatible media legislation in Southeast Europe is moving forward due to efforts of the Stability Pact Media Task Force. In FYR Macedonia, the Media Working Group operating under the auspices of the Stability Pact is drafting a new broadcast law. In a joint effort, media outlets, union representatives and NGO’s cooperate closely with governmental bodies and the lawmakers in Parliament. An agreement was reached to introduce the new law in parliament in early summer 2003.
In Moldova, a complete review of the legal framework for the broadcast media has been carried out under the auspices of the Stability Pact, identifying necessary changes to be made in particular to the independence of the public broadcaster and the regulatory body for the media.
A Freedom of Information law is being drafted in Montenegro because access to public information can increase transparency and is a powerful tool against corruption. In countries that already have such a law (Bulgaria, Romania, Bosnia-Herzegovina, Albania) activities are underway to make sure people do really receive the requested information: training of public officials, support for litigation and monitoring.
Region-wide activities to improve and decriminalise defamation legislation include litigation, amendments to penal and civil codes and monitoring. The aim is to introduce legislation in line with European standards. Following the recommendations of a regional conference organised by the Council of Europe, October 2002 in Strasbourg, the Media Task Force will assist countries to translate this into legislative changes. Solid improvements for the working conditions of journalists can be obtained by putting the burden of proof with the claimant, not to give special protection to politicians and heads of state and to remove defamation from the penal code.
The Media Task Force assists media development in Southeast Europe by supporting quality TV productions, local journalism education and changes to the legal framework for the media. It has established Media Working Groups, composed of media professionals and experts as well as politicians and civil society representatives, in all SEE countries. This network supports and assists media development in Southeast Europe mainly by advocating the modernisation the legal framework. Accordingly, in various countries laws governing the media are being reviewed, renewed and improved. The Task Force aims at increasing media freedom, diversity and professionalism.
